THE AGREEMENT CONTRACT

Brief of the case:

As you may already know, Daniel and Sebastian arrived to Mexico on May 25, 2007. Samantha Lowry was to arrive on may 28, 2007 (EXHIBIT 1) but instead she started to file secret suits,(EXHIBIT 2) including for the illegal custody of Sebastian after Daniel was in Mexico, without Notice or Knowledge of Daniel of such proceedings, (EXHIBIT 3) (EXHIBIT 4) (EXHIBIT 5)Samantha Lowry also took over the home of Daniel and all his documents by braking into his home and for the purpose to take illegal possession of all his property and personal documents.

Samantha Lowry had refuse to give the travel documents to Daniel for him and Sebastian to return to the United States.(EXHIBIT 6) Then Samantha Lowry aided by Fraudulent attorneys Milner Firm and Minton Firm made impossible for Daniel to come back to the United States or be present or been heard in court, obstruction of Justice for Daniel to not have Due Process.

The Texas Family code 152.205 is very specific

§ 152.205. NOTICE; OPPORTUNITY TO BE HEARD;
JOINDER. (a) Before a child custody determination is made under
this chapter, notice and an opportunity to be heard in accordance
with the standards of Section 152.108 must be given to all persons
entitled to notice under the law of this state as in child custody
proceedings between residents of this state, any parent whose
parental rights have not been previously terminated, and any person
having physical custody of the child.
(b) This chapter does not govern the enforceability of a
child custody determination made without notice or an opportunity
to be heard.
(c) The obligation to join a party and the right to
intervene as a party in a child custody proceeding under this
chapter are governed by the law of this state as in child custody
proceedings between residents of this state.

But also by the U.S constitution and Human rights as well as International Treaties a person has the right to be present and defend himself in court.

Amendment 14 of the United States:
"nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws."

Samantha Lowry and her attorneys worked in concert to take those privileges and rights from Daniel Pavon Cuellar and took everything from Daniel Pavon without Due Process,(EXHIBIT 7) even his homestead against Texas Constitution, (Daniel Pavon bought his homestead on 1997 and Samantha did not even live in the homestead of Daniel),even his personal documents and clothes, even 1732 paintings (1200 the Lowry Family claim to have burned) a custody that is not valid by Texas Laws and basic rights, but in fact a kidnapping with ransom. But also attempted to take everything from his family and even won a completely frivolous suit (EXHIBIT 8) for 35000000 out of Jurisdiction against the parents of Daniel without notice or any type of notification (Kept Secret purposely and by Fraud) (EXHIBIT 9) along many other illegal actions of the Lowry Family and their attorneys.

The best Evidence of all to prove Samantha Lowry and the Attorney Firms fraud, is with this Exhibits and how they made impossible for Daniel and Sebastian Pavon Cuellar to return to the United States (EXHIBIT A , EXHIBIT B , EXHIBIT C and EXHIBIT D) the best way to know Samantha is to read this (EXHIBIT 10) an email written to Daniel on Thanksgiving day of 2007

Samantha had place in risk of Dead the Life of Sebastian in several occasions; a normal father will do everything to protect his son, specially a new born who is completely vulnerable by at least been at his side at all times. The purpose of the Milner Firm and the Lowry Family was for Daniel to return his son, and they will keep withholding Daniel´s travel documents so he could not return, but also they had sent Joseph Lowry to pick up the Sebastian, a man who apparently was accused of sexual abuse to a minor child in the past. Samantha has 3 other sisters, Jemima Lowry, Scarlett Lowry and Jorgina Lowry, but also the mother Susan Lowry and the father John Lowry, yet, they sent Joseph Lowry. A Man who at 27 years old lived in a tree house.
Also they picked for delivery of Sebastian the British Embassy, and simoultaneously they were threatening to take him to England. Also, they had Andrew Westbrook with the dead threat against Daniel Pavon if he will return.
Even so Daniel Attempted to return Sebastian, to the British Embassy, but The Vice Consul Nicola Mockridge said Daniel Needed and attorney (EXHIBIT 11) , which at that time he could not afford any.
Important to say, Daniel started contact with Embassies of the United States and the United Kingdom and also with Secretaria de Relaciones Exteriores since the beginning of this problem, asking for help, Daniel sent them evidence of all what was happening, also to FBI, Police, Interpol and anyone who could possibly help, but nobody did.
Justice was denied against the U.S Constitution.

The true Fact is that they did not give any choices to Daniel Pavon Cuellar purposely to take everything from him and his family on a fraud that started since January of 2007 (EXHIBIT 12).
Imagine! 5 Fraudulent Attorney Firms, A Criminal Police Director, Embassies and many others only attacking Daniel and without giving him any choice, and if you add that Daniel had to be a father to a new born! and keep him sheltered from the harm of this sick people using Sebastian to commit this Texas Size Fraud...
We will keep adding evidence every week, until Daniel will have the opportunity to be heard and be present in court and have Due Process of Law. We have around 5000 documents of evidence against them, and still keeping the strongest evidence against them, unpublished..

In the best interest of Sebastian and to have Due process of Law, (DUE PROCESS: to have the opportunity to be heard and be present in court to defend your rights, property and privileges) and agreement had to be reach.

Samantha Lowry and Daniel Pavon negotiated since September to November all the terms of the agreement, finally on November Samantha Lowry and Daniel Pavon agreed on all the terms and clauses of the agreement, then, it was passed to their attorneys who met in Austin on November 28, 2007 apparently at the offices of Mark Ray Hernandez and hammered the agreement for 10 hours. Along those present in that meeting were Mark Ray Hernandez, Forest Nelson Attorneys representing Guadalupe and Raul Pavon (since they were also included in the agreement) Roy Barrera a Texas Attorney Representing Daniel Pavon in the United States, Milner Firm including Joe D Milner, Minton Burton Foster and Collins and Bratton and Bratton Firm Representing Samantha Lowry, also present Samantha Lowry Lowry and John Lowry.

In Mexico also the agreement was reviewed and agreed by “Zepeda, Eckstein y associados”Attorneys for Daniel Pavon in Mexico.

Finally after 10 Hours of hammering the agreement as Mark Ray Hernandez calls it. The agreement was finally reached with all attorneys and Lowry Family.

The agreement was Executed On December 3, 2007 in Mexico City at the offices of “Zepeda, Eckstein y associados” and Daniel complied with all the terms and clauses of the agreement. At the time the contract was executed, the Consul of the American Embassy in Mexico, The Consul and Vice consul of the British Embassy in Mexico , The Director for Family of Secretaria De Relaciones Exteriores, A pediatrician who checked Sebastian and found him in excelent shape and perfect health, a Mexican Notary Public as well as many others were present as witnesses and representing each of their countries and their assigned legal duties. The Contract was signed and Notarized UNDER OATH on the United States Embassy, also on the British Embassy and with a Mexican Notary, to give it full validity and enforcement in three countries.

The Contract was made for the fairness of Justice, on the best interest of Sebastian and bring a peaceful and lawful process to the conflict, and most important, for each to have their Human rights, Lawful rights and privileges respected to have due process of law with the opportunity to be heard and be present in court, no one will waive any rights and the contract is simply to start all court proceedings from the beginning were each person will have the opportunity to be heard and be present in all court proceedings while Sebastian could be with both parents and safe, with weekly visits to a government entity for his safety.

The Legal rights of a child, is to have both parents and to grow with both parents.

The Travel Documents of Sebastian were to remain in the United States Embassy with the Consul K. Cecil Scott and could only be pick up in presence of both parents and with their signatures, also K Cecil Scott was in charge and assumed the legal duty and responsibility of the enforcement of such agreement. As Seen on the Exhibit Below (LAST PAGE).

But, Samantha Lowry Kidnapped Sebastian That same day and drove to the United States with Sebastian, then sold a property of 20 acres on April 1, 2008, also Milner claims to have started to sale the paintings becoming a Fraud penalized with over 10 Years in Jail. Along several other crimes already committed by these people includes: Perjuries, trespassing, criminal mischief, theft, extorsion and suspects of Murder along other crimes described in this Site.

Samantha Lowry, Tristan Nind, as well as Milner are suspects of the murder of Raul Pavon on February 8, 2008. The murder took place less than two weeks after Raul Pavon had countersue Samantha and deliver the evidence of the crimes of Milner, Lowry and others involved, (Pending investigation)

Secretaria de Relaciones Exteriores is asking for the return of Sebastian to Mexico.

We hope British Authorities will act fast. Especially after your intervention in this case against Daniel Pavon when he was wrongfully accused, as the evidence on this site shows in detail and with evidence and in fact, was for the sole purpose to take his rights, privileges, property, assets and freedom.

The Harm Samantha Lowry did to Sebastian out of all of this, to gain illegal profits, will harm the poor Baby Sebastian forever, and has destroyed the Pavon Cuellar family forever.

Furthermore, you have enough evidence in this site to start Justice against this MOB.

We beg the British Government to bring Justice and into Safety Sebastian.

Especially to MEG MUNN who was actively involved in all this case from the beginning and has strong involvement in HUMAN RIGHTS, please Meg Munn Enforce Human Rights.
Also ANNE SNELGROVE who actively was involved on this case and who contacted even Tony Blair to give full consular support to Lowry Family (to commit this fraud), please bring Justice and fairness to this case.
Also k Cecil Scott, Consul for the Unied States Embassy, enforce the agreement as you suppose to.
To FBI and Internal affairs of Austin Police Department, take action.
